COLUMBUS, Ohio — A 16-year-old charged with shooting his younger brother in the head at Easton Town Center on February 12th 2011. The teenager has had numerous run-ins with law enforcement, including incidents in which he threatened to kill a fellow high school student and did the same to a member of his own family, at gun point.

Andrew Kelley faces a charge of felonious assault stemming from Saturday's shooting that left his brother seriously hurt. He is expected to face a juvenile court judge on Tuesday afternoon.

Police said that they anticipate enhancing the charge to murder if Andrake Kelley, 15, dies. He remains hospitalized in critical condition at Nationwide Children's Hospital. Police said he's Andrake is not expected to survive. If he doesn't, his brother could be charged with a delinquency count of murder.

Andrake Kelley was shot on Saturday night after an altercation inside the Apple Store at Easton.

Investigators said the argument spilled outside the store and continued a few blocks away. Sources close the investigation told 10TV News that Andrew Kelley claimed he was trying to fire gunshots in the air when he shot his brother.

Court records showed that Andrew Kelley has had a number of run-ins with law enforcement since dating back to when he was 13 years old, 10TV's Ashleigh Barry reported.

About a year ago, Andrew Kelley was charged with menacing and placed on probation after he threatened to shoot a fellow student at Marion-Franklin High School. Three months later, he was charged with domestic violence after allegedly pulling out a gun and threatening to "pop" his aunt.

Andrew Kelley's past contains other offenses, including breaking and entering, receiving stolen property, robbery, theft and possession of marijuana, Barry reported.

Teen Murdered By His Older Brother

February 17th 2001 - A Columbus, Ohio teenager that was critically wounded by a single gun shot to the head during a shooting at Easton Town Center has died. New charges will likely be filed against his older brother who authorities said pulled the trigger.

Andrake Kelley, 15, died on Wednesday night (February 16th) in the Intensive Care Unit at Nationwide Children's Hospital, according to police. He was shot, in front of on-lookers, on Saturday night after a dispute near the mall's Apple Store.

CPD have identified and charged his older brother, Andrew Kelley, 16, as the shooter. He was charged earlier this week with felonious assault. His younger brother Andrake's death is the city of Columbus's 9th homicide of 2011.

Kelley was scheduled to appear in court today but the judge and prosecutor said there was no point in dealing with the previous charges when the death of the victim will mean new charges.

Kelley is next scheduled to appear in court on March 4th at 9 a.m.
