24-year-old Stephen Smith and Latosia Warren are under arrest for shooting a 13-year-old girl.

CLEVELAND - After the shooting of a 13-year-old girl on Monday March 7th 2011 a Cleveland man, who failed to turn himself into police after speaking with detectives about the case, has been arrested for gun charges and is now facing felonious assault for the shooting.

Brianna Hines, 13, was shot in the back of the head Monday evening while sitting on the couch at a home on Matilda Avenue in Cleveland. On Tuesday the 8th of March, police arrested 24-year-old Stephen Smith. The shooting happened the day before and occurred during the course of a drive-by shooting targeting Hines' home.

Cleveland police Sgt. Sammy Morris said on Thursday that Smith faces several charges, including Felonious Assault and having a Weapon Under Disability. Having a "Weapon Under Disability" means that a convicted felon in possession of a firearm. In this case, caught while committing another crime. One count of having a weapon under disability is punishable with 5 years in prison under ORC 2923.13. One count of Felonious Assault ORC 2903.11 is punishable to up to 8 years in prison.

Latosia Warren, 25, of Cleveland, was also arrested in connection to the shooting for obstruction of justice. Warren, at first, claimed that she was the one who pulled the trigger during the drive-by but has since re-canted that statement.

Brianna Hines, the young victim in this case, has been declared brain dead and remains in critical condition at Metro Health Medical Center in Cleveland.
